Blitz Jong End User License Agreement
1. Agreement
This End User License Agreement (this "Agreement") is a binding agreement between you and MarcoHard LLC, 8401 Mayland Dr Ste A, Richmond, VA 23294-4648, USA ("we", "us"), and governs the copy of Blitz Jong (the "Game") that you obtain, install, or use through Steam.
By installing or using the Game, you accept this Agreement. If you do not accept it, do not install or use the Game.
You must be at least 13 years old (or older where local law sets a higher minimum). If you are under the age of majority where you live, a parent or legal guardian must review and accept this Agreement on your behalf.
Our Terms of Service, Privacy Policy, and Refund Policy also apply to your use of the Game and the online services it depends on, and are available at blitzjong.com. Where this Agreement and those documents differ on a matter specific to the Steam version, this Agreement controls; on all other matters the Terms of Service control.
2. Steam Subscriber Agreement
Your acquisition and use of the Game through Steam is also subject to the Steam Subscriber Agreement between you and Valve Corporation. If any term of this Agreement conflicts with the Steam Subscriber Agreement, the Steam Subscriber Agreement controls for your Steam copy of the Game. Valve is not a party to this Agreement.
3. License
Subject to your compliance with this Agreement, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Game for your own non-commercial entertainment. All rights not expressly granted are reserved.
4. Restrictions
You may not:
(a) reverse engineer, decompile, or disassemble the Game, except to the extent that applicable law expressly permits it despite this restriction;
(b) use cheats, automation software, bots, memory or packet modification, or any other means of interfering with normal gameplay, or exploit bugs for advantage;
(c) modify or create derivative works of the Game, except through features we provide for that purpose (such as Steam Workshop submissions);
(d) rent, lease, sell, sublicense, or otherwise transfer the Game or your account, or make the Game available to others as a service;
(e) remove or obscure any proprietary notices; or
(f) use the Game to violate applicable law or the rights of others.
5. Online Service Required
The Game is an online, server-authoritative multiplayer game. Game state, including the wall and all players' hands, exists only on our servers. The Game requires a continuous internet connection and our online services to function; there is no offline or single-player mode, and the Game will not be playable if those services are discontinued.
We may modify, suspend, or discontinue the online services, in whole or in part. We will give reasonable advance notice of a permanent discontinuation of the online services where practicable.
6. Account
Playing the Game requires an account with us, which may be created through your Steam account. You are responsible for activity under your account. Account terms, suspension, and termination are described in our Terms of Service.
7. Virtual Currency and Virtual Items
The Game includes virtual coins ("Virtual Currency") and digital items ("Virtual Items"). Regardless of how they are described in-game, you receive only a limited, personal, revocable license to use them within the Game. You acquire no ownership interest.
Virtual Currency is tied to your account, cannot be transferred between accounts, and cannot be redeemed for money or anything of value outside the Game. It is a closed-loop license usable only within the Game; it is not money, a deposit, stored value, prepaid access, or a payment instrument, and cannot be used to pay any person.
Most Virtual Items are permanently bound to your account and cannot be traded or transferred. Certain items that we designate may exist as Steam inventory items and may be transferable through Steam features where we and Valve permit it, subject to the Steam Subscriber Agreement. Any such permission is granted by us and Valve and may be modified or withdrawn; it does not make an item your property or give it value outside Steam.
Virtual Currency purchased on Steam is purchased from your Steam Wallet through Valve's in-app purchase system.
8. Purchases and Refunds
Purchases of Virtual Currency made through Steam are processed by Valve and are subject to Valve's refund policy and the Steam Subscriber Agreement. Requests for refunds of Steam purchases must be made through Steam Support; we cannot process them for you.
Virtual Currency and Virtual Items are delivered immediately. Our Refund Policy explains what happens to items bought with refunded currency and how we handle chargebacks.
Except as required by applicable law or provided by Valve's refund policy, purchases are final, and unused Virtual Currency and Virtual Items are not refunded when an account is closed or terminated.
9. User Content and Workshop
If you submit content through Steam Workshop or otherwise, you keep ownership of it and grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, distribute, and publicly display it in and in connection with the Game and its marketing. You confirm that you have the rights necessary to grant that license. Submissions are also subject to the Steam Subscriber Agreement and our Creator Policy.
10. Updates
We may update the Game and its content, including balance changes, and may add, change, or remove features and items. Updates may be delivered automatically through Steam.
11. Term and Termination
This Agreement applies for as long as you use the Game. We may suspend or terminate your license if you materially breach this Agreement, as described in our Terms of Service. On termination you must stop using the Game. Sections 7, 8, 11, 12, 13, and 14 survive.
12. Disclaimers
To the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
13. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our total liability arising out of or relating to the Game will not exceed the greater of the amount you paid us (or paid through Steam for the Game and in-game purchases) in the twelve months before the claim, or USD 50. Some jurisdictions do not allow these limitations, so they may not apply to you.
14. Governing Law and Disputes
This Agreement is governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. Dispute resolution, including the binding individual arbitration provision and the class action waiver, is set out in Section 14 of our Terms of Service and applies to disputes under this Agreement. That section includes a 30-day opt-out. Nothing in this Agreement limits any dispute resolution rights you have against Valve under the Steam Subscriber Agreement.
15. Third-Party Software
The Game includes third-party software provided under their own licenses. Those notices and licenses are available in the Game's credits and licenses screen, and apply to those components instead of this Agreement where they conflict.
